These Terms of use apply to the provision of NextDot services through its website and applications. Upon creating a NextDot account you agree to enter into a legally binding contract with NextDot. In case you do not agree with the content of this contract, please do not create an account and do not otherwise use our Services. The collection and processing of your personal data is subject to our Privacy Policy, as in force.

• Definitions

  Services: Services that we provide through our website and application(s), which are indicatively:

  • For individual professionals/ employees:

    • aggregating feedback data regarding a professional project from one or more sources, such as peer employees, i.e. employees working within the same company (“Organization”), which are further transformed into standardized assessments and useful insights aiming at professional growth;
    • providing skill development recommendations, learning plan recommendations by analyzing feedback data and performance data to determine potential career development options, potential talent development skills and potential skills improvement;
    • tracking performance on a professional project and identifying skill gaps of the professional/ employee and;
    • offering simulated scenarios/ projects related to potential future professional rules and promote career advancement.

  • For Organizations (as defined herein):

    • providing analytics on employee performance data, motivation level data, development progress data to enable further talent management, strategic planning and decision making;
    • determining a correlation between changes in employee’s motivation and the feedback data and performance outcomes and;
    • providing guidance to employees on giving constructive feedback.

  User: Any person who has an active account with NextDot and uses part or all the Services.

  NextDot network: All the users of NextDot services who have an account.

  Organization: Any third party who is represented by an administrator or administrators in the NextDot network and is the owner of a specific professional project, which its employees and/or contractors, who are also users of the Services, undertake to complete.

  Dot(s): A project of professional nature, which is coordinated by an Organization, and which is undertook by a user within NextDot network. The user will further request and receive feedback regarding the Dot from other users of the NextDot network.

  Affiliates: Any legal entity that is partially or wholly owned by NextDot or is in any way related to NextDot.

  Profile: An online professional profile of a user, where the user can share his/her personal and professional information, and his/her performance and skill growth within a Dot.

  Privacy Policy: Our data protection policy, in force from time to time, which describes how we collect and process your personal data when you use our Services.

• Obligations of the user

  As a user of our Services, you agree to the following:

  • You are at least at the minimum age required by the applicable law in your country to consent to the use of the Services.
  • The data you provide on your profile, including personal data (i.e., name, surname etc.) and professional data (i.e. job title, employer etc.), are real, accurate and are not in violation of any legal provision. In case you create a false identity profile on NextDot or impersonate any other person, NextDot reserves the right to close your account with immediate effect and initiate legal proceedings before any competent authority.
  • Upon creating an account with NextDot, you shall have a strong password and you shall not make the content of your account and the password available to anyone.
  • You shall use our Services only in accordance with the present Terms of use and the Privacy Policy, as in force.
  • As a user you shall use our Services in a professional manner that would allow for the creation of a supportive and productive environment for Nextdot network, i.e. you shall engage in Dots and update them to reflect ongoing projects, provide feedback that would contribute to the embracement of a culture of continuous professional development, support other users with encouraging comments, ensure that any feedback provided will be constructive and specific for the ongoing Dot and will also be polite and helpful to other users and aimed at fostering growth for them.
  • You shall ensure that any content you publish (i.e., posts, feedback comments, photos, videos etc.) (i) does not infringe any rights of any third party, including, without any limitation, proprietary rights, privacy rights etc. and (ii) is not offensive, racist, inappropriate or abusive in any way, towards any third party.
  • You must refrain from committing any attempt of fraud or security breach, i.e. inserting viruses or harmful software on the website.
  • You shall ensure that your use of our Services does not infringe any intellectual property rights of third parties.
  • You must not disclose any confidential or sensitive information regarding any natural or legal person that you do not have right to disclose (i.e. confidential information about your employer - Organization of the Dot, the Dots and/or other users), in any manner, through your profile, feedback comments or through private conversations with other users and you must respect the privacy settings of other users and avoid exposing sensitive information to broader audiences.
  • You must inform NextDot immediately in case you are aware of any breach of any of obligations of a user of our Services, as provided herein.

  If you act as an administrator of an Organization, you additionally guarantee that you have the power and authority to represent the Organization for the purpose of using our Services. NextDot bears no responsibility for any act and/or omission of an administrator in case the administrator is not authorized to use our Services on behalf of the Organization.

• Obligations of Next Dot

  • We shall provide our Services in accordance with these Terms of use, as in force from time to time.
  • We will ensure that the information and content that you share or post will be visible only based on your choice preferences in your account settings (e.g. restricting the visibility of certain information on your profile from others etc.).

• Rights of NextDot

  • We reserve the right to take immediate action against any user who breaches any of the obligations under article 2, including without limitation, suspension or termination of use of our Services, limit access to the website, terminate your account and/or initiate legal proceedings before any competent authority.
  • We have the right to refuse to publish any information and/or content submitted by any user and remove any information and/or content already published, if such information and/ or content is in breach with these Terms of use.

• Fees

  Any user and/or Organization will have the right to subscribe to paid Services of NextDot, upon paying the applicable fees for each Service, as set out on our website.

  The fees are exclusive of VAT and all other taxes or duties and are non-refundable for any reason, except as expressly provided otherwise in these Terms.

  The user and/or Organization will be charged automatically either at monthly or annual base, according to the subscription period of each Service.

• Disclaimer and limitation of liability

  NextDot is not required to verify and/or confirm the accuracy of the information provided by the users of its Services and is not in any way responsible for any liability of any third party in relation to the publication of any inaccurate or false information and/or any confidential information by any user.

  To the fullest extent permitted by law, NextDot, including its affiliates, will not be liable in connection with these Terms for any loss of profits or loss of goodwill and reputation, including, without limitation, offensive or defamatory statements, loss of data and/or any indirect, incidental, consequential, special or punitive damages.

• Termination

  These Terms will be terminated and cease to apply, at any time, in case you permanently close your user account. Upon termination, you will have no access to our Services.

  For the retention of your personal data, following the closure of your account, our Privacy Policy applies.

  NextDot has the right to terminate these Terms with immediate effect, without incurring any damage, in the following cases:

  • NextDot ceases to provide its Services or
  • The user has breached any of its obligations under article 2 of these Terms of use.

• Intellectual Property

  Nextdot is the exclusive owner of all intellectual property rights relating to the Services, including without limitation, the platform, the software of the website and of any trademarks, logos, distinctive signs and graphics of the website and relevant applications.

  Nothing in these Terms will allow the transfer from NextDot to any user and/or Organization any of its intellectual property rights, and all such rights will remain exclusively to the ownership of NextDot.

  NextDot will provide to the user and/ or the Organization a limited, revocable, non-exclusive and non-transferable right to access and use the Services solely for the purpose of use of our Services in accordance with these Terms of use.

  The user and/or the Organization shall not: (i) modify, create or attempt to create derivative copies of the software or the website content in whole or in part; (ii) decompile, disassemble or otherwise modify the code of the software or (iii) distribute, sub-license, assign, share, sell, rent, lease, or otherwise transfer the software or the content of the website to any third party.

  The user and/or the Organization hereby grants NextDot, a perpetual and royalty- free license to display on its website and application(s) the user’s personal data and all other information and material provided by the user and/or the Organization, as represented by its administrator, for the sole purpose of the provision of the Services by NextDot.

• Governing Law

  These Terms of use shall be governed by and construed in accordance with the laws of Greece. All disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Athens.

• General Terms

  The user acknowledges that entering these Terms has not relied on any representations, undertaking or promise given by or implied from anything said or written whether on the website, the Internet or in negotiation between the parties except as expressly set out in these Terms.

  If any term of the present Terms of use is deemed invalid or unenforceable, the other terms shall remain in force, as if the invalid term was not included in the present Terms.

  No failure or delay by NextDot to exercise any rights or remedy provided under these Terms or by any applicable law shall not constitute a waiver of that or any other right or remedy, nor shall it preclude or restrict the exercise of that or any other right or remedy.

  NextDot may modify these Terms and its Privacy Policy from time to time. Any changes we may make in the future will be notified and made available to you through our website or by other means. Your continued use of our Services shall be deemed your acceptance of these Terms of use and our Privacy Policy, as updated and in force.
